1. AGREEMENT TO TERMS

These Terms of Service constitute a legally binding agreement between you and Zagros AI, Inc. governing your access to and use of the Usecaller service available at https://usecaller.io.

By using the Service, you agree to these Terms. If you disagree, do not use our Service.

2. SERVICE DESCRIPTION

Usecaller is an AI-powered calling tool that automatically initiates phone calls to sales leads within 5 minutes of receiving them to improve lead conversion rates.

3. ACCOUNT REGISTRATION

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities under your account
  • Providing accurate information
  • Notifying us of unauthorized use

4. SUBSCRIPTION AND PAYMENT

  • The Service is subscription-based
  • Payments are due in advance
  • All payments are non-refundable except as expressly stated
  • We may change fees with 30 days' notice

5. LICENSE AND RESTRICTIONS

We grant you a limited, non-exclusive license to use the Service for your business purposes.

You shall not:

  • Copy or modify the Service
  • Reverse engineer the Service
  • Use the Service for illegal purposes
  • Transmit harmful code
  • Build a competitive product

6. YOUR CONTENT

  • You retain ownership of your content
  • You grant us a license to use your content to provide the Service
  • You represent that you have necessary rights to your content
  • You must comply with telemarketing and privacy laws

7. INTELLECTUAL PROPERTY

The Service is owned by us and protected by intellectual property laws.

8. TERM AND TERMINATION

  • You may terminate by canceling your subscription
  • We may terminate if you breach these Terms
  • Upon termination, your access will cease

9. DISCLAIMERS AND LIMITATIONS

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID DURING THE 12 MONTHS PRECEDING THE CLAIM.

10. INDEMNIFICATION

You agree to indemnify Zagros AI, Inc. from claims arising from your use of the Service, your content, or violation of these Terms.

11. CHANGES TO TERMS

We may modify these Terms by posting revisions on our website. Your continued use constitutes acceptance.

12. GENERAL PROVISIONS

  • Governing Law: Delaware
  • Dispute Resolution: Binding arbitration in Dover, Delaware
  • No class actions
  • These Terms constitute the entire agreement
